Foreclosure - Definitions


Auction - There are many auction formats. Auctions may take place online, at the property, at a central location (like the Tampa Bay Convention Center). In most cases, there is a period where you can preview the home at least a few days in advance.  Bidding usually requires that you have your pre-approval for financing with you, and provide a downpayment at the auction.  You may enlist the services of a Real Estate Professional, and in most cases their fee is covered by the seller.  An Absolute Auction is when there is no minimum price, and the property will sell to the highest bidder.  Most Auctions have a Reserve Price which is the minimum price the seller will accept, and if this is not met - the property does not sell.

Bank Owned - The house has already gone through the foreclosure process.  The seller is the bank.  Banks don't want to own the houses, they want to sell these homes quickly.  You can usually make an offer and negotiate the price.  Be sure to review the bank's addendums to the contract.  These sales are As-Is with Right to Inspect.

BPO - Broker Price Opinion.  The sellers will normally request at least 2 BPO's to gather information about current market conditions for homes similar to the subject property.

HUD - HUD homes have a special purchase process.  You must fill out about 30 pages of forms, and your agent will enter your bid into an online system.  Owner Occupants get first chance to bid (for about 10 days).  Bids are reviewed automatically at the deadline, based on the net value to the seller.  If the home is still available, Investors may bid.  Owner Occupants have restrictions on when they can turn around and sell the home.  There are hefty fines for lying on these forms for both the buyer, and the real estate professional.  You must make your offer to purchase a HUD home through a Real Estate Salesperson or Broker who is active with the HUD system.

Pre-Foreclosure - The Bank has not yet foreclosed, but have filed paperwork and the foreclosure is due to happen soon.  Many of these are Short Sales.

Short Sale - The seller is going to net less than the amount owed to the lender(s) on the primary and secondary mortgages.  The seller is asking the lender to foregive the difference.  The seller must prove they have no additional assets available to pay the difference.  Since the lender may take a loss, they must approve the sale.  They review the contract in their Loss Mitigation Department, then request multiple Broker Price Opinions to determine if the sale price or a foreclosure would net them more money.  The primary lender's decision takes about 45 - 60 days.  If there is a secondary lender, it can take another 45 - 60 days.  Listings and Contracts of sale include special Addendums for Short Sales.  Lenders will usually agree to up to 3% of Buyer's closing costs to be paid by seller.

IMPORTANT NOTICE: If you are behind on payments, and you are looking to sell quickly - do not go to companies who say they will buy your home for cash quickly.  Many will offer you a nominal fee of $10 and will request to record the transaction on video - and will not want you to have a Real Estate Professional or Attorney present.  If they do this - they own your home, and you still own the debt!  If you want to talk with one of these companies - make sure you have a Real Estate Professional or your Attorney present.  They are quick, and slick, and once they have video of them giving you money, and you signing the deed - you've lost the house.  Instead - Put your home on the market with a Short Sale Specialist, and they will assist you with the paperwork with your lender(s).  Call me at 813-850-9665 or email me for more information.
