If you are selling and buying investment properties, consider a 1031 Tax Deferred Exchange.  A 1031 can be used to defer taxes on the capital gains from the property you are currently selling, until the sale of the property you are buying.  There are many rules, but the savings can be tremendous.

Commercial property has many definitions:

  • Multi-family residential property including apartment complexes.
  • Vacant land
  • Shopping Centers, Strip Malls, Auto Repair, Warehouse, Parking lots
  • Office space can be entire buildings or just an office condo
  • Businesses for sale
  • TIC or Tenant In Common transactions

A TIC or a Tenant In Common transaction is where you purchase a portion or shares of a property, in return for a portion of the income.  An example might be a large shopping mall.  Maybe the purchase price for the entire property would be $20 Million.  Instead there are a number of partners (up to 16) who purchase a percentage each.  Each may purchase a different amount, and they receive a proportionate share of the income.

A 1031 Tax Deferred Exchange allows you to sell 1 or more investment properties, and buy 1 or more investment properties at an equial or higher price, and defer the taxes on the sale(s) until you sell the newly acquired properties.  There is a strict limitation of 180 days from the date of the first of the related sales, to the last of the related purchases.  No exceptions on that 180 day rule.  Not hurricanes / earthquakes / nothing.  Don't miss that date!!
